Agreement

I, _______________________________ [print name] (the “Renter”), acknowledges and agrees, as evidenced by the Renter’s signature below that the Renter has read, is aware of, and accepts full responsibility for and is bound by the terms and conditions contained in this agreement (the “Agreement”) with GoGo RV and all directors, officers, owners, representatives, agents and employees (collectively, “GOGO RV”), which Agreement also consists of the Price List, the Departure Form and the FAQ form.

THIS AGREEMENT WITNESSES that in consideration of the mutual covenants herein contained and other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the Renter and GOGO RV agree as follows:

RENTAL PERIOD

1. Rental Unit – GOGO RV agrees to rent to the Renter the rental unit identified as a ________________ _____________ (the “rental unit”) in accordance with the Price List, for the period from _______________________ to __________________________ (the “Rental Period”). GOGO RV will ensure that the rental unit is in top condition, roadworthy and set up at the time of rental.

2. Due Care – The Renter covenants and agrees to treat the rental unit with care and consideration during the Rental Period and return it in the same condition in which it was received.

Fuel For This Unit Is Unleaded Gasoline (87 octane or higher) Not Diesel.

The Renter covenants and agrees that failure to use correct fuel will result in costly damage to the rental unit and the Renter will be responsible for any and all repairs associated with such damage. Such damage will not be covered by insurance.

Right to Refuse

3. Termination – GOGO RV may terminate this Agreement and repossess the rental unit at any time and place if the Renter is in violation of any of the terms and conditions outlined in this Agreement. GOGO RV reserves the right to refuse rental of rental unit to the Renter at any time in its sole discretion.

Rental, Cancellations & Refunds

4. Booking Deposit – A $1000.00 non-refundable deposit is required from the Renter to GOGO RV at the time of booking to confirm and hold the reservation. The deposit will be charged to the credit card provided by the Renter, and will go towards the Renter’s final payment for the booking.

5. Final Payment – Final payment for the rental for the balance of the rental fee is required from the Renter to GOGO RV at the commencement of the Rental Period and will be taken from the credit card on file, unless alternate payment is requested by the Renter. Additional optional packages and Accident Deductible Discount can be reserved in advance and paid by the Renter to GOGO RV for at time of pick up.

6. Damage Deposit Authorization – For incidentals and damages, a $5,000.00 damage deposit will be charged to the credit card of the Renter on file at the commencement of the Rental Period, unless the ADD option is selected. The damage deposit will be returned within 24 hours following and subject to the final inspections (see below).

* GOGO RV is not responsible for exchange rate variations while a damage deposit is being held*

7. Cancellation – GOGO RV shall assume no liability in the event a booking is cancelled, rescheduled, changed, postponed or interrupted due to any unforeseen occurrence or other event that makes rental impracticable, illegal or impossible. However, if a booking must be cancelled by GOGO RV for any reason before the commencement of the Rental Period, GOGO RV will refund the full amount thereto paid by the Renter.

8. Cancellation Fees – In the event that the Renter cancels the reservation, the following amounts will be charged to the Renter from the credit card on file:

  • $500.00 = Cancellation any time after confirmation.
  • $1000.00 = Cancellation 15-30 days prior to the commencement of the Rental Period.
  • 50% of the daily rental rate (minimum $1000.00) = Cancellation 1-14 days prior to the commencement of the Rental Period.
  • 100% of the daily rental rate = Cancellation on the first day of the Rental Period or due to a no show.

Check-In & Check-Out

9. Pickup and Parking – The rental unit may be picked up on the first day of the Rental Period from 3:00 pm – 8:00 pm. Exceptions may be made with prior arrangement. The Renter may park their personal vehicle at GoGo RV’s office location for the duration of the Rental Period.

10. Return Time – The rental unit must be returned to GOGO RV’s office location, ready for final inspection, by 11:00 am on the last day of the Rental Period. Late returns are not permitted without GOGO RV’s period written permission. If the rental unit is returned late, overtime hours will be charged at $75.00 per hour or portion thereof. Please remember; the next clients may be waiting to start their RV adventure!

11. Fuel – The Renter agrees that:
a.
The rental unit must be returned with a full tank of fuel. If the Renter does not refuel the rental unit, the Renter agrees to pay for refueling at a rate of $2.50/L.
b. A $50.00 CAD charge applies if the propane tank is not returned full.

12. Cleaning – The Renter agrees that:
a.
The rental unit must be returned clean and tidy, free of garbage, personal items and food. The fridge and freezer must be empty and clean. It is not necessary to sanitize the bathroom and kitchen, vacuum, or wash linens, as a thorough cleaning will be done by GOGO RV for the next renter. A charge of $200.00 CAD will be applied to the Renter’s credit card on file if the rental unit is returned in an unsatisfactory state.
b. The holding tank must be emptied by the Renter, flushed out and not plugged up at time of drop-off. A $50.00 CAD charge will be applied to the Renter’s credit card on file if the holding tanks (black or grey water) are not emptied.

 13. Early Return/Unused Kilometers – The Renter will not receive any refunds for early returns or unused kilometers.

 14. Final Inspection – All charges are subject to a final inspection by GOGO RV of the rental unit. The Renter may be required pay the adjusted amount at GOGO RV’s sole discretion based on the condition of the rental unit upon return, kilometers used, the time of return, or otherwise.

Operating Conditions

15. Usage Instructions – GOGO RV has provided the Renter with instructional videos for the Renter’s safety and comfort. The Renter agrees to take the time to watch these videos, in order to avoid unintentional damage to the rental unit or injury to the Renter and others.

16. Capacity – The number of persons travelling in the rental unit must not exceed eight people. The combined weight of occupants and cargo should never exceed 1,400 kg or 3,086 lbs.

Of note is that a full tank of water is 170 kg (374 lbs), grey tank is 180kg (396 lbs) and black tank is 140kg (307 lbs).  The weight of a recreation vehicle motor home completed at factory with full propane tank and full engine fuel is 4,940 kg or 10,881 lbs (empty water tank, empty grey and black sewer tanks).  The GCWR of this recreational vehicle motor home is 9,080 kg or 20,000 lbs.

17. Driver – The Renter agrees that:
a.
All drivers must be 23 years of age or older and have a valid driver’s license from his or her origin and be listed as a Renter in this Agreement. Additional drivers are free of charge but their license must be provided to GOGO RV at the time of signing this Agreement. Please check license validity before reserving the rental unit.
b. Seatbelts MUST to be worn at all times while the rental unit is in motion.

18. Pets & Smoking – The Renter agrees that:

a. Smoking is not permitted in the rental unit. GOGO RV reserves the right to charge an additional fee of $1,000.00 CAD if the rental unit is returned smelling of smoke. No recreational drugs (including cannabis) may be used in or while operating the rental unit.
b. No pets are permitted in the rental unit, including service animals. Charges of up to $1,000.00 CAD may apply at GOGO RV’s sole discretion if smoke or pet odour/hair is present at the time of return of the rental unit.

19. Restricted Use – The following uses of the rental unit are not permitted. 

a. Operation by impaired individuals.
b. Transporting hitchhikers or other persons for hire.
c. Carrying flammable/explosives, fireworks, propane bottles/tanks, Illicit/illegal drugs, and/or chemicals.

20. Travel Restrictions – The Renter agrees that:

a. Festivals/Large Events – Use of the rental unit for any large outdoor event or festival may be subject to an additional deposit or surcharge at GOGO RV’s sole discretion. Use of rental unit for festivals and events must be explicitly requested at time of reservation, or else it is not permitted.
b. Road Restrictions – The rental unit may not be used on beaches, non-public roads, logging roads, gravel roads, off-road areas, and/or flooded areas.
c. Restricted Areas – Travel to the following restricted areas will result in forfeiture of the full damage deposit by the Renter to GOGO RV:

    • Travelling through Death Valley national park is not permitted from June 1st to August 30th.
    • Visiting Black Rock City, Nevada (“Burning Man”) is not permitted in the rental unit.
    • Alaska, Yukon, Northwest Territories – Travel is prohibited in Alaska, Yukon and the Northwest Territories unless it is explicitly requested at the time of reservation and approved by GOG RV. The additional fee for travel to these areas is $800.00.
    • Travel outside Canada and Continental United States is not permitted.
    • Travel to areas with freezing level is not permitted. Please note:

Please note:

It is NOT allowed to have water in the rental unit’s tanks when temperatures are at freezing levels. Failure to comply may result in costly damage to the fresh water and holding tanks and the water lines, result in costly damage to the rental unit and the Renter will be held responsible for any and all repairs associated with such damage. Such damage will not be covered by insurance.

21. Additional Conditions The Renter agrees that it is responsible for, and its credit card on file will be charged due to, the following, to be determined in GOGO RV’s sole and reasonable discretion:

a. No towing or pushing other vehicles is permitted. A $500.00 CAD penalty will be charged if there is any evidence that towing has occurred.

b. No fish or game meat are permitted in the fridge/exterior storage compartments of the rental unit. A minimum fee of $500.00 will be charged for refrigerators/storage compartments requiring additional cleaning and deodorizing.

c. A $100.00 charge applies if any sticker, decal, hook or double-sided adhesive is applied to or attached on or in the rental unit, and/or if any sticker from the exterior of the rental unit is missing or damaged.

d. Damage to the rental unit due to overloading/improper/insecure load or otherwise, which costs of repairing any and all damage and/or mechanical repairs to the rental unit will be charged to the Renter.

Emergency Assistance

Any and all damages, accidents, fire, theft and/or injuries involving the rental unit itself and/or a third party (vehicle, person, property and/or otherwise) must be reported to the police immediately. Any and all damages or malfunctions must be reported to GOGO RV as soon as possible.

22. Reimbursement for Rental Unit Malfunction – In the event of a mechanical breakdown of the rental unit that is immediately reported to GOGO RV, which requires the rental unit to be in repair for more than 12 hours, certain living/transportation expenses are reimbursable by GOGO RV to the Renter, at GOGO RV’s sole discretion. In such a case, GOGO RV agrees to reimburse the Renter for a maximum of $40.00 CAD per day per person for lodging costs, and a maximum of $40.00 CAD per day per party for transportation expenses. Total provisions are limited to a maximum of $3,000.00 CAD per Rental Period. The Renter must present all receipts to GOGO RV in order to be granted a refund for expenses. Expense reimbursement is void in the case of a collision, accident, or failure to call GOGO RV immediately.

Towing the rental unit to a repair shop is allowed, however the prior approval of GOGO RV is required.

Roadside Assistance is provided through Jayco the coach manufacturer.

23. Violation Tickets – The Renter covenants and agrees to pay all fines, highway toll charges and all other costs associated with traffic/parking violations/charges incurred during the Rental Period. A copy of the ticket and payment receipt must be submitted to GOGO RV at the termination of the Rental Period. Unpaid traffic fines arriving to GOGO RV during or after the termination of the Rental Period and subsequent interest charges will be immediately charged to the Renter’s credit card on file, plus a handling fee of $100.00 CAD.

Insurance and Liability

24. Liability Coverage – GOGO RV maintains liability insurance coverage on the rental unit to a maximum of $5,000,000.00 CAD for any bodily injury and property damage liability claims arising from the operation or use of the rental unit, provided all safety and operating instructions provided have been followed by the Renter. Premiums for this basic liability coverage are included in all rental rates, which also include premiums for collision insurance and comprehensive insurance. Reduction and waiver agreements are subject to the express terms of this Agreement and are null and void if any of the terms of this Agreement are breached by the Renter.

25. Accident Deductible – The Renter covenants and agrees that it is reasonable for an accident deductible of $5,000.00 CAD, incurred due to any and all collisions involving the rental unit. Damages and deductibles are subject to amendments (without notice) and all applicable taxes. If the ADD, as defined below, is purchased by the Renter it will lower the cost of the accident deductible from $5,000.00 to $750.00 CAD.

In the event that the ADD is not purchased by the Renter, the Renter will pay GOGO RV a deposit of the full deductible amount of $5,000.00 CAD at the commencement of the Rental Period. This deposit will be reimbursed to the Renter upon return of the rental unit at the termination of the Rental Period if the deductible is not incurred.

26. ADD (“Accident Deductible Discount”) –An accident deductible discount is available to the Renter for an additional cost of $30.00 CAD per day, up to a maximum of $800.00 CAD per Rental Period. A minimum charge of $210.00 CAD will apply regardless of the Rental Period duration, if the ADD is purchased.The following damages are covered under the ADD (see exceptions under “5 – Exceptions”):

  • Motor vehicle accidents / Collision (including roof and underbody);
  • Hit and Run / Vandalism / Vehicle theft / Fire;
  • Damage due to break-ins;
  • Tire damage;
  • Windshield damage;
  • General glass damage;
  • Impact with an animal;
  • Damage caused by back-up maneuvers such as dents, rips, tears or breaks to the rental unit;
  • Damage caused as a result of a natural disaster (hail, floods, storms);
  • Damage to the interior of the rental unit; and
  • Replacement cost for lost keys or keys locked inside the rental unit.27. Exceptions to all Coverage – All coverage agreements including ADD are null and void in the event of the following occurrences to the rental unit:
  • Damage that was caused as a result of negligence / willful act of the Renter or any third party in the control of or care of the Renter;
  • Damage that was caused as a result of any third party using the rental unit without permission (not registered on this Agreement);
  • Failure to maintain proper fluid levels;
  • Damage caused by using the wrong fuel or wrong fluids;
  • Damage due to misuse of the brakes (overheating), transmission or any other parts of the power train;
  • Damage due to violation of restricted travel areas (see “Travel Restrictions” above);
  • Damage caused by ignoring height restrictions and other road signs;
  • Driving under the influence of alcohol, drugs and/or other substances;
  • Damage caused as a result of travelling on ice roads, bodies of water, sand, or in freezing areas;
  • Damage caused as a result of the use of snow chains; and
  • Failure to follow the operating conditions outlined in this Agreement.

27. Liability Insurance Exclusions – The rental unit shall not be left unattended unless all windows have been closed, the doors locked and the ignition key removed. If the rental unit is missing or stolen and/or the Renter does not have the keys to return to GOGO RV at the termination of the Rental Period, the Renter is responsible for the total value of the vehicle and all damages, costs, expenses, loss of business and otherwise incurred by GOGO RV as a direct or indirect result.

28. Third Party Insurance – If the Renter is covered for damages through a third party insurer, the Renter irrevocably agrees to reimburse GOGO RV for any and all damages to the rental unit, identified at GOGO RV’s sole discretion, at the termination of the Rental Period. It is the Renter’s responsibility to re-claim the amount of such damages from such third party insurer, and the Renter acknowledges and agrees that GOGO RV will not claim the amount from the insurer on the Renter’s behalf. It is the Renter’s responsibility to examine the Renter’s own insurance policy to ensure that all damages are covered.

29. Damage – The Renter acknowledges and agrees that GOGO RV is not responsible for any of the following: a) any and all damage to the personal property of the Renter or otherwise; b) any and all personal injury or death; c) loss of any and all property left in, upon or carried in the rental unit; and/or d) any and all damage or personal injury as a result of use/operation of the rental unit.

30. Indemnification – The Renter will indemnify, defend and hold harmless GOGO RV from and against all claims, losses, costs (including legal fees on a solicitor and own client basis), damages or actions by third parties that arise out of, or are attributable to, the Renter’s use of the rental unit and/or failure to perform its obligations under this Agreement.

31. Limitation of Liability – GOGO RV’s liability will be limited to the value of the total rental price for the Rental Period and does not include any consequential damages of any kind, including but not limited to loss of time, loss of profit, loss of business, relocation and/or hotel costs or inconvenience, unless otherwise provided for in this Agreement.

GENERAL

32. Binding Effect – This Agreement will enure to the benefit of and be binding upon the parties and their respective heirs, administrators, executors, successors and assigns.

33. Jurisdiction – This Agreement will be interpreted under the laws of the Province of British Columbia.

34. Assignment and Amendment – Neither party will assign this Agreement without written consent of the other. Any amendment or modification of this Agreement or additional obligation assumed by either party in connection with this Agreement will only be binding if evidenced in writing. Email is considered to be an acceptable method of approving an amendment or modification.

35.Dispute Resolution – The parties agree to meet and discuss in good faith any dispute between them regarding any matter that is the subject of this Agreement. Unless the Agreement specifies otherwise, if the parties are unable to reach agreement on any dispute, either party can request that the dispute be referred to mediation.
